We reserve the right, at our absolute discretion, to update, and/or revise these Terms and Conditions or withdraw or change offers at any time. We may change them by updating them and posting a notification of the changes on the website. Continued use of the website will indicate your acceptance of the changes.
The website (energyplusargos.co.uk) is operated by Argos. If you have any queries relating to these Terms and Conditions please contact the energyplus Argos helpline on 0345 640 0881. Lines are open Monday to Friday 8am till 8pm and Saturday 9am till 5pm. Calls are charged at the local rate.
1 - Use of the Website
1.1.We may at any time without notice or liability:
a) temporarily restrict access for repairs, standard maintenance or the introduction of new services: and
b) change, suspend or discontinue the Website; and
c) change the availability of any feature, database, or Content; and
d) impose limits on certain features and services; and
e) restrict your access to parts of or the entire Website
1.2. We cannot guarantee that the website will be fault free or that it will meet your requirements. Please report any faults in the Service to the onsite feedback
2 - Registration and Information Security
2.1. The website services will require registration. To register you must be over eighteen (18) years of age and a UK resident. You agree your registration is personal to you. It may not be shared and is not transferrable.
2.2. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your details. Your contact details must match those of your SSE energy account. We may check your registration details to ensure they are correct and we may close your account if we suspect or believe that you have deliberately provided incorrect information.
2.3. We reserve the right:
a) to decline a new registration or suspend an account at any time; and
b) to terminate access to all or parts of the website without notice; and
c) to create limits on use
2.4. At initial registration, we will ask you to choose a user name and password. You will need to enter these details whenever you sign into the website. You must keep your password confidential and not disclose it to anyone else or write it down. If you suspect that someone else knows your password or security details, you should change your password and let us know immediately by the online contact us form
2.5. Our acceptance of your registration will take place when we notify you by email that your registration has been accepted.
2.6. Following successful registration you will be able to access your personal account and view your current energyplus Argos Gift Card balance and add top ups. All top up orders placed on this website will be subject to acceptance in accordance with these Terms and Conditions.
2.7. Your account will hold details of your energyplus Argos balance for you to subsequently access in your “Recent History. We recommend that you print out these Terms and Conditions and any top up acknowledgements for your own records.
3 - The energyplus Argos Scheme
3.1. For every one kilowatt hour (1kWh) of energy you use on the energyplus Argos tariff, you'll earn 0.622 energyplus Argos points.
3.2. Each full energyplus Argos point equates to a credit of £0.002 to be spent at Argos.
3.3. One kilowatt hour (1 kWh) of electricity and/or gas excludes the standing charge and VAT applicable to the energyplus Argos tariff.
4 - The energyplus Argos Gift Card
4.1. Existing energyplus Argos tariff customers will be issued with an energyplus Argos Gift Card automatically in February 2018. The energyplus Argos Gift Card has a unique number and must be retained by you and used whenever Argos credit is spent at Argos.
4.2. Every three (3) months (a “Quarter”), SSE will inform Argos how many energyplus Argos points you have earned in the preceding Quarter. Your points will be automatically converted to Argos credit and applied to your energyplus Argos Gift Card.
4.3. The first conversion of energyplus Argos points to your energyplus Argos Gift Card will occur by 28 February 2018 and thereafter on a Quarterly basis.;
4.4. If you register, we will notify you by email when Argos credit has been loaded to your card. Argos credit will be readily available after such notification.
5 - Earning energyplus Argos points
5.1. You will continue to earn energyplus Argos points provided your electricity and/or gas supply remains with SSE on the energyplus Argos tariff. If you close your SSE account or change tariff you will no longer earn energyplus Argos points.
6 - Energyplus Argos Gift Card Top Up
6.1. You may top up your energyplus Argos Gift Card at a ten percent (10%) discount through the energyplus Argos online rewards scheme website.
6.2. The maximum top-up credit you may purchase is five hundred pounds sterling (£500) (equal to a discounted cost to you of £450) during each Quarter.
6.3. Top ups may be purchased at any time, in one or several transactions, during each Quarter but may not be purchased retrospectively.
6.4. Top up Argos credit will be loaded to your energyplus Argos Gift Card at the point of successful payment and is available for use after fifteen (15) minutes
6.5. We regret that top up payments cannot be cancelled, once processed.
7 - Spending energyplus Argos points
7.1. Argos credit cannot be exchanged for cash and may only be redeemed in accordance with these Terms and Conditions.
7.2. Your Argos credit may be spent online at Argos.co.uk, in-store at any Argos store, Argos in Sainsbury’s or via the Argos App
7.3. All items sold by Argos are subject to stock availability and “Argos Terms and Conditions of Sale”. A copy of the “Argos Terms and Conditions of Sale” can be found here https://www.argos.co.uk/help/terms-and-conditions/.
7.4. Customers may supplement the Argos credit on their energyplus Argos Gift Card to purchase their chosen item. Accepted payment methods are detailed within the Argos Terms and Conditions of Sale and at checkouts.
7.5. Any balance remaining on an energyplus Argos Gift Card after a transaction cannot be refunded but will remain on the energyplus Argos Gift Card for future use. No change will be given.
7.6. Argos reserves the right to refuse acceptance of any energyplus Argos Gift Card they believe, in their reasonable opinion, has been obtained by theft, fraud or other than in accordance with the terms and conditions of this promotion.
7.7. All purchases using the energyplus Argos scheme must be for personal, domestic use only and should not be used for any business purpose including the re-sale of goods.
8 - Returns, Cancellations & Substitutions
8.1. All purchases made with your energyplus Argos Gift Card will be subject to the Argos Terms and Conditions of Sale. Your statutory rights are not affected.
8.2. Any faulty or damaged goods supplied by Argos may be returned to Argos, in accordance with the Argos ‘After Sales Care Service’.
8.3. Any refunds obtained under the Argos ‘30-day money back guarantee’ will be issued to a separate Argos Gift Card.

8.5. We regret that top up payments cannot be cancelled, once processed.
9 - Changing your Energy Contract and Leaving the energyplus Argos Scheme
9.1. If youleave SSE and/or the energyplus Argos tariff, you will automatically leave the energyplus Argos scheme.
9.2. If you leave the energyplus Argos scheme, any remaining Argos credit will remain on your energyplus Argos Gift Card. Subject to Condition 9.3, if you do not use the balance within two (2) years of the last points allocation, all credit on your energyplus Argos Gift Card will expire.
9.3. You will be given six (6) months’ notice if SSE and/or Argos terminate the energyplus scheme. At the end of the six (6) months’ notice period, all unused Argos credit on your energyplus Argos Gift Card will expire.
10 - Lost energyplus Gift Cards
10.1. Lost energyplus Argos Gift Cards may be replaced at SSE’s discretion. Any balance outstanding at the date we are notified of the loss will be applied to a new energyplus Argos Gift Card. Please contact us to arrange cancellation and replacement (link).
10.2. We regret that we are unable to accept any liability for card misuse between loss and notification.
11 - Payment
11.1. Where we need to take payment from you for top up, we will take payment from your card at the time you place your order, at which time our payment system will check and process your card details provided.
11.2. The price you pay for top up is the price displayed on this website at the time of placing your order.
11.3. If we discover an error in the price of an order we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancel it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the order, you will receive a full refund.
12 - Intellectual Property
12.1. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
12.2. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
13 - Liability and Indemnity
13.1. Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
13.2. Subject to Condition 13.1 above, Argos will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied, statutory or otherwise regarding the contents or availability of the site, or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses, or bugs, or represents the full functionality, accuracy, reliability of the website. Argos will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and Argos accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
13.3. Subject to Condition 13.1 above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at Condition 8 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.
13.4. Subject to Condition 13.1 above, Argos will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or loss of goodwill or reputation; or consequential, special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
13.5. Notwithstanding the above, subject to Condition 13.1 Argos' aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
13.6. This Condition 13 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
13.7. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
14 - Miscellaneous Provisions
14.1. The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
14.2. Unless otherwise stated, we have selected our products on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by appropriate insurance.
14.3. Argos shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
14.4. To provide increased value to our customers, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for:
a) the privacy practices of such websites;
b) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources; or
c) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
14.5. You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party unless agreed upon in writing by Argos.
14.6. Argos reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party.
14.7. If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
14.8. These terms and conditions do not create or confer any rights or benefits enforceable by any person that is not a party (within the meaning of the U.K. Contracts (Rights of Third Parties) Act 1999) except:
a) J Sainsbury plc (as defined below) shall have the right to enforce any rights or benefits under these terms and conditions;
b) the J Sainsbury plc Group of companies shall have the right to enforce and take the benefit of the rights or benefits of any limitation or exclusion or limitation of liability in these terms and conditions;
c) a person who is a permitted successor or assignee under clause 10.6 above of the rights or benefits of these terms and conditions may enforce such rights or benefits
No consent from the persons referred to in this Condition 14.8 is required for the parties to vary or rescind these terms and conditions (whether or not in any way that varies or extinguishes rights or benefits in favour of such third parties).
14.9. No delay or failure by Argos to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of Argos.
14.10. These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and Argos relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and Argos for your use of this website
The energyplus Argos tariff is supplied by “SSE” and associated brands: “Southern Electric”, “Scottish Hydro” and “SWALEC” which are all trading names of SSE Energy Supply Limited Registered in England & Wales No. 03757502 (Supply of Electricity) and Southern Electric Gas Limited Registered in England & Wales No. 02716495 (Supply of Gas), both members of the SSE Group. All decisions relating to the value of points in respect of energy consumed are determined at SSE’s sole discretion.
